Is it really free for me to hire a vaccine injury attorney for my SIRVA claim?
Well, if you live in the United States and you are filing your SIRVA or other vaccine related claim in the Federal Court of Claims, the answer is yes. But there must be a catch, right? Actually, no.
Vaccine injury cases, such as SIRVA claims, are filed under the Vaccine Injury Compensation Program (“VICP”). The VICP explicitly forbids attorneys from charging their clients for representing them in vaccine injury cases. It’s not even an option for the attorneys.
Obviously, attorneys aren’t going to work for free, so the attorneys make their money in VICP cases by filing a petition with the Court of Claims when their client’s claim has concluded. The Court of Claims then decides whether the attorney can be compensated for their time and how much compensation the attorney receives.
For this reason, there is no reason not to hire a vaccine injury attorney if you have SIRVA or another vaccine related injury. It literally cost you nothing and saves you time and money since the attorney will typically cover the costs of filing the petitions and getting the medical records.
