How Much is My SIRVA Injury Claim Worth?
One of the most common questions I get from clients and potential clients is “What is my SIRVA claim worth?” Unfortunately, I cannot give people a definitive answer on what a claim is worth, and every claim is different. There’s a myriad of factors that affect the value of a claim. The most obvious one, of course, is the extend and duration of a person’s injuries. However, everything from who opposing counsel is to how quickly a person wants their claim resolved play a significant factor in the ultimate value of a claim.
That being said, we do have some information available to us that can help a person get an idea of what their claim might be worth. I will reiterate that every claim is different, and this information does not guarantee you any results on your claim.
In recent years, the median SIRVA claim has been worth around $80,000.00. This number can vary based upon the injuries of a person and at what stage of the claim process they choose to settle their claim. For example, there is a process called “entitlement” where the court decides whether the person making the claim is entitled to compensation. However, a claimant can settle their claim before the court even decides entitlement. Obviously, claims settled after the court has determined the claimant is entitled to damages are more valuable. The recent settlement range for cases pre-entitlement has been between $50,000.00-$92,500.00. The median pre-entitlement settlement had been around $70,000.00. The median settlement after entitlement has been around $95,000.00 and most cases have settled in the $75,000.00 to $122,000.00 range.
There are also cases that go to a hearing where the court decides the damages awards. Those awards vary based upon the individual’s injuries and other factors. If a person has required surgery, it is not uncommon that their case settles for an amount exceeding $100,000.00 or that the court awards them an amount in excess of $100,000.00.
It is important to keep in mind that individuals who can prove they have unpaid medical costs or lost wages are also entitled to collect those damages on top of their pain and suffering. It is also important to note that the injured person keeps the entire amount of the settlement or award. The settlements and awards are not subject to attorneys’ fees. Rather, the VICP pays the attorneys.
