Will the Covid-19 vaccine be covered under the Vaccine Injury Compensation Program?

This is the question that everyone wants an answer to. The unfortunate answer is that at this point nobody knows. However, there are many people who work in the vaccine injury field that feel it is very likely that the Covid-19 vaccine will be added to the VICP eventually. There are additional questions that adding the Covid-19 vaccine to the VICP also raises. For example, if the Covid-19 vaccine is added will it be applied retroactively? Will people who were injured before the vaccine was added to VICP be entitled to compensation? Will people who filed claims under the Countermeasure Injury Compensation Program be eligible to file claims under the VICP?

There are more questions than answers currently. However, there is legislation that is currently pending that would make it easier for the Covid-19 vaccine to be added to the VICP. In my opinion, and I can’t emphasize enough that this is simply my opinion and should not be taken as legal advice, I believe that the Covid-19 vaccine will eventually be added to the VICP list. I also believe it will be applied retroactively allowing people who were injured before the vaccine was added to file claims. Finally, I believe there will be a provision that allows individuals who filed claims under CICP to also file VICP claims even though there may be some limitations on recover for individuals filing under the VICP who previously received a recover under CICP.
